2. TYPES OF PERSONAL DATA WE COLLECT AND PURPOSE

2.1 While accessing our product and services

We collect personal data to the minimum scope necessary for the provision of “Artropia” “(hereinafter as “Artropia”, the “product” or the “services”). The personal data we collect can be freely provided by the user, or, in case of usage data, collected automatically when using our product and services.

1) to contact you for customer support, deliver courses and push promotional materials, we need to collect your first name, last name, phone /WhatsApp number and email address.

2) to complete your account profile, we collect the name, gender, age and grade of your children.

3) to issue your invoice, we collect your address, phone number, bank account number and email information.

4) to share feature of the product, we collect the contents shared and comments.

5) to contact us for customer support, we need any chat history or recording depending on your questions or requests.

6) to keep track of your orders and respond to related user complaints, we need to collect your purchase records, including your name, address, email, phone number, CPF and bank account number, provided by PayPal, Stripe, WixPay or credit/debit card. If you make a purchase, your card information is not held by us, it is collected by the above-mentioned payment processing platform, who specializes in the secure online capture and processing of credit/debit card transactions.

3. CHILDREN UNDER THE AGE OF 13

WE RECOGNIZE THE PRIVACY INTERESTS OF CHILDREN AND ENCOURAGE PARENTS AND GUARDIANS TO TAKE AN ACTIVE ROLE IN THEIR CHILDREN’S ONLINE ACTIVITIES AND INTERESTS. For that reason, we do not collect any personal data at registration stage from children. WE DO NOT KNOWINGLY COLLECT ANY PERSONAL DATA UNDER THE AGE OF 13 WITHOUT THE CONSENT OF THEIR PARENTS AND GUARDIANS. If you believe we may have any personal data of your children without your consent, you can contact us to remove such data at privacy@artropia.com.


The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this section “parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children” or “child”).  It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information. Depending on your child’s activities when using or accessing the Services, you may from time to time be required to agree to additional terms and conditions.
This Section for Children under the Age of 13 (“Policy”) notifies parents of:

  • The types of information we may collect from children.

  • How we use the information we collect.

  • Our practices for disclosing that information.

  • Our practices for notifying and obtaining parents’ consent when we collect personal information from children, including how a parent may revoke consent.

  • Our practices to protect the security, integrity, and confidentiality of children’s personal information.  

  • All operators that collect or maintain information from children through these Services.

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE ALLOWING YOUR CHILD TO USE OUR SERVICES.  BY ALLOWING YOUR CHILD TO USE ANY OF OUR SERVICES (OTHER THAN TO READ THIS PRIVACY POLICY FOR THE FIRST TIME), YOU ARE AGREEING THAT YOU AND YOUR CHILD WILL BE BOUND BY THIS PRIVACY POLICY, WHICH MAY CHANGE FROM TIME TO TIME.  IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, DO NOT ALLOW YOUR CHILD TO USE OUR SERVICES, INCLUDING POSTING A PHOTOGRAPH.    
 

This section of the Policy only applies to children under the age of 13 and supplements our general privacy policy.  Terms that are defined in the general privacy policy have the same meanings as used in this section.

 

3.1. Information We Collect from Children 
If we learn we have collected personal information from a child in a manner inconsistent with COPPA’s requirements, we will either delete that personal information or seek parental consent. 


Information We Collect. We may collect the following information from children: 

  • 1) Enrollment Information: to complete your account profile, we collect the name, gender, age and grade of your children.

  • 2) Information to Obtain Parental Consent:  We may ask a child for a parent’s email address or other permissible contact information in order to request consent.  If we do not receive parental consent within a reasonable time, we will delete the contact information and any other related information collected from the child.  We may conduct other methods of parental consent permitted by COPPA, including requiring the parent, in connection with a monetary transaction, to use a credit card, debit card, or other online payment system that provides notification of each discrete transaction to the primary account holder.  

  • 3) Social Features: We enable registered users to post to public areas of social media sites and posting to public areas of the Services (“Social Features”).  The nature of these features allows children to disclose personal information about themselves.  We do not monitor or review this content before it is posted, and we do not control the actions of third parties with whom your child shares his or her information.  We encourage parents to educate their children about safe internet use and to monitor their children’s use of social features.

  • 4) Persistent Identifiers:  Our online services may automatically collect persistent identifiers for internal operations, including to provide and improve our online services, conduct analytics, authenticate users, personalize content, maintain the security and integrity of the service, and to ensure legal or regulatory compliance.  Specifically, we may collect Internet protocol or IP address, pages and content visited, the type and version of operating system or web browser, device ID, or location data.  We, or our third-party service providers, may collect this information using HTTP cookies, flash cookies, HTML5 and Flash local storage, web beacons/GIFs, embedded scripts, and ETags/cache browsers (“Cookies”).

3.2. How We Use Your Child’s Information
We use the personal information we collect from your child to: 

  • provide him or her with access to the Services;

  • communicate with him or her about activities or features related to the Services;

  • track his or her performance.


3.3. Our Practices for Disclosing Children’s Information
We do not share or transfer children’s personal information other than as described in this section. Additional rights may apply to California consumers.  Please see our California privacy rights section.

 

If your child uses the same device you use when you use the app or the Services, we may share the following data that was created during your child’s use of your device with the following business partners who have also assumed confidentiality obligations regarding the data:
1) Other service providers involved in the supply of the services including Wix, Huoban and payment service providers.

2) We may disclose aggregated information about many of our users, and information that does not identify any individual or device.  In addition, we may disclose children’s personal information:

  • To third parties we use to support the internal operations of our Services and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential.

  • If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others, including to:

    • protect the safety of a child.

    • protect the safety and security of the Services; or

    • enable us to take precautions against liability.

    • to law enforcement agencies or for an investigation related to public safety.
       

In addition, if we are involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the personal information we have collected or maintain to the buyer or other successor.
 

3.4. Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored with such countries as America, Singapore, China where information is stored by our service providers.  

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping the password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services. The information you share in public areas may be viewed by any other users of the Services.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

3.5. Accessing and Correcting Your Child’s Personal Information

  • At any time, you may review your child’s personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using your child’s information.

  • If: (a) you have questions or comments about our Policy; (b) wish to make corrections to any personal information provided by you or your child; (c) want to opt-out from receiving future commercial correspondence, including emails, from us or our affiliated companies; (d) wish to withdraw your consent to sharing your child’s personal information with others; or (e) you have other privacy related questions or concerns.  You can review, change, or delete your child’s personal information by:

4. PURPOSES OF PROCESSING PERSONAL DATA

We process your personal data for specific purposes and process only the personal data relevant for achieving that purpose. Depending on our relationship with you and the products and services that we are providing, we use collected personal data for following purposes as assigned to the above description of the respective processing activity:
1) for enrollment
2) for provision and administration of our services, including to facilitate participation in live courses and facilitate to improve your account profile.
3) for processing of your request and orders of our study tools and commodities.
4) for optimization of our product and services and improvement of user experience.

5. SHARING OF PERSONAL DATA

In order to provide you with more convenient and prompt services, we share your personal data with our partners and entrust other companies with such tasks. 6. CROSS-BORDER TRANSFER OF PERSONAL DATA

As the product and services offered to you are part of the services of a company established in China, your personal data will be transferred to China (to exemplify: the cross-border transfer happens for the server is located in China). 

7. RETENTION AND DESTRUCTION OF PERSONAL DATA

We only process and store your personal data for as long as required by the purpose they have been collected for.

After the termination of your Terms of Services with us, we will delete your personal data in due time in accordance with the applicable laws unless the retention of your personal data is necessary to meet legal or regulatory requirements, especially to comply with commercial and tax retention obligations, to resolve potential disputes or to preserve evidence within the scope of the statutory limitation provisions. Should this be the case, we will retain the personal data concerned until the end of the respective statutory period.

Thereafter, your personal data will be securely deleted or destroyed. Personal data stored in an electronic file format will be erased by a technical tool which prevents the recovery of the information. Personal data printed in a paper record, print media or a document is destroyed into scrap.

8. SECURITY OF PERSONAL DATA

We take appropriate security measures to prevent unauthorized access, disclosure, modification, unauthorized destruction of the personal data or any accidents such as hacking or computer viruses.

The processing of personal data is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition, we restrict the number of staff in charge with access to your personal data to the minimum level and frequently conduct trainings and educations so that they comply with the confidentiality obligations with respect to your personal data.

9. LINKS TO OTHER WEBSITES AND SERVICES

Artropia may contain links to other websites and services run by other organizations. This privacy policy applies only to our product and services of Artropia‚ so we encourage you to read the privacy statements on the other websites and services you visit. We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our product.

In addition, if you linked to our product and services from a third-party site, we cannot be responsible for the privacy policies and practices of the owners and operators of that third party site and recommend that you check the policy of that third party site.

10. WITHDRAWING CONSENT TO CERTAIN ADVERTISEMENTS

At any time, you may withdraw your consent or object to the receipt of advertising message or push, the personalization of advertisements or the sharing of your data with our partners (except for technical service providers):

11.  CALIFORNIA PRIVACY RIGHTS

The California Consumer Privacy Act of 2018 (“CCPA”) requires us to provide the following notice to California residents.

 

This notice does not apply to employment-related information of California-based employees, job applicants, contractors, or similar individuals. Where noted in this notice, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B information”) from some of its requirements.


A. Information we collect
The information we have collected about California residents in the last 12 months is described in Types of personal data we collect and purpose section above. That information corresponds with the following categories of personal information under the CCPA:

Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers.

C.Sharing of personal information
The business and commercial purposes that we have shared your personal information in the last 12 months are described above in Sharing of personal data. More specific information on that sharing is as follows: 

  • Sharing your personal information for business purposes. We have shared the following categories of personal information with our affiliated companies, service providers and public or government (including enforcement) authorities for our business purposes:

D.Selling of personal information
The CCPA sets forth certain obligations for businesses that “sell” personal information to third parties. Based on the definition of sell under the CCPA and under current regulatory guidance, we do not believe that we engage in such activity and have not engaged in such activity. While California residents have the right to opt-out of the sale of their personal information under CCPA, we do not sell personal information to third parties. If our practices change, we will update this Privacy Policy and take any necessary action to comply with applicable law.

 

E.Your right to know
You have the right to request that we disclose certain information to you about our collection, use and disclosure your personal information over the past 12 months. Once we verify your request, we will disclose to you: 

  • The categories of personal information we collected about you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting that personal information. 

  • The categories of third parties with whom we share that personal information.

  • If we disclosed your personal information for a business purpose, disclosures for a business purpose,, identifying the personal information categories that each category of recipient obtained.

We do not provide access rights to B2B information. The aforementioned B2B information refers to the personal information involved in business-to-business communications or transactions.

 

F.Your right to obtain a copy of your personal information
You have a right to obtain a copy of the specific pieces of personal information we collected about you (also called a data portability request). Once we verify your request, we will provide you a copy of your personal information that is responsive to your request. 
We do not provide portability rights to B2B information.

 

G.Your right to delete your personal information
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We do not provide deletion rights to B2B information.

 

H.Your right to opt-out of sale of your information
We do not sell your personal information, so we do not offer an opt-out of sale option. 

 

I.How to exercise your CCPA rights
To exercise your right to know, right to obtain a copy, or right to delete your personal information as described above, please submit your request to us by: 

 

J.How we verify requests and respond to requests
Before fulfilling your request, we take steps to verify you are who you say you are or that you have authority to act upon someone else’s behalf. Therefore, upon receipt of your request, we will request additional information that we need to verify you and, if you are submitting a request on behalf of someone else, to verify that you are permitted to act on that person’s behalf.  


When we contact you to request verification information, please respond and provide the information that we have requested. Depending on the nature of the request you make, we may require you to verify your identity to either a reasonable degree of certainty or high degree of certainty. This may mean that we need to match two or three pieces of information that we hold about you with information that you provide to us. In some cases, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request or that you are authorized to make the request on behalf of someone else. 


In addition to providing the information we need to verify you or your authority, you must provide us with enough information so that we can understand, evaluate, and respond to your request. We cannot respond to your request or provide you with personal information if we cannot confirm the personal information relates to you. 


We will only use personal information provided in a verifiable consumer request to verify your identity or authority to make the request and to locate relevant information. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and to understand, evaluate, and respond to your request.


We cannot delete personal information in those situations where our retention is required for our own internal business purposes or otherwise permitted by the CCPA (such as fraud prevention or legal compliance). In these situations, we will retain your information in accordance with our records retention program and securely delete it at the end of the retention period.

 

K.Who may submit requests? 
Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may also make request on behalf of your minor child. You may designate an authorized agent to make a request on your behalf by registering such person or entity with the California Secretary of State. 
 

L.How often you can submit requests? 
You may make a CCPA consumer request twice within a 12-month period. 

 

M.Response timing and format

We make every attempt to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

Upon receipt of your email to us at privacy@artropia.com, we will deliver our written response by replying to your email.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. When you request a copy of your personal information, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity easily.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

N.Non-discrimination
We will not discriminate against you for exercising any of your CCPA rights. You have a right not to receive discriminatory treatment by us for exercising your privacy rights. 

 

O.Other California privacy rights
California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@artropia.com.

12.  NEVADA PRIVACY RIGHTS

Nevada residents have the right to opt out of the sale of certain "covered information" collected by operators of websites or online services. We currently do not sell covered information.

13.  UPDATES OF THIS PRIVACY POLICY

We may, from time to time, change and/or update this Privacy Policy to reflect related laws or any changes in relation to our services and products. If this Privacy Policy changes in any way, we will post an updated version on this page. We will store the previous versions of this Privacy Policy in our documentation achieve. We recommend you regularly review this page to ensure that you are always aware of our information practices and any change.

As per queries, complaints, feedbacks or other matters on personal data protection which arise from the use of this service, please contact us. All correspondence received by us from you (written or electronic inquiries) is classified as restricted-access information and may not be disclosed without your written consent. The personal data and other information about you may not be used without your consent for any purpose other than for response to the inquiry, except as expressly provided by law.
